Please read these Terms and Conditions ("Terms") carefully before using the software service operated by FeedSync at https://feedsync.net ("Service").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

1. Acceptance of Terms

By using our Service, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be legally bound by them. If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to these Terms.

2. Use of the Service

You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of others. You must not:

  • Use the Service in any way that violates applicable laws or regulations
  • Attempt to gain unauthorised access to any part of the Service
  • Transmit any unsolicited or unauthorised advertising or promotional material
  • Use automated tools to scrape or extract data from the Service without permission
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity

3. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of FeedSync and its licensors. Our trademarks may not be used in connection with any product or service without prior written consent.

You retain ownership of any content you submit to the Service, but grant us a worldwide, royalty-free licence to use, display, and distribute such content in connection with operating the Service.

4. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy at https://feedsync.net/privacy.

6. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. FeedSync does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

5. Limitation of Liability

To the maximum extent permitted by applicable law, FeedSync shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total liability to you for any claim arising under these Terms shall not exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim, or (b) AUD $100.

7. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive.

8. Refund Policy

Where required by law (including under the Australian Consumer Law), we will provide refunds for faulty or misdescribed products or services. For change-of-mind refunds, please contact us at hugo@feedsync.net within 14 days of purchase. We assess each request on a case-by-case basis.

9. Subscriptions & Billing

Some parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring basis. Your subscription will automatically renew unless cancelled at least 24 hours before the end of the current period. You may cancel your subscription at any time through your account settings or by contacting hugo@feedsync.net.

10. Dispute Resolution

These Terms are governed by the laws of Australian Consumer Law and the laws of New South Wales. Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the courts of New South Wales, Australia, and you consent to personal jurisdiction in those courts.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
